Federal landscape in brief
As of Nov 3, 2026, the United States has no single comprehensive federal AI Act analogous to the EU AI Act. Federal activity is a mix of sector enforcement (for example FTC actions and TAKE IT DOWN), procurement and use rules for federal agencies (OMB memoranda), voluntary standards (NIST), and executive orders that direct agencies. States have filled much of the detailed legislative space on frontier transparency, employment AI, election deepfakes, and chatbot disclosures.
Federal (selected instruments)
- TAKE IT DOWNPublic Law 119-12, signed May 19, 2025, criminalizes publication of non-consensual intimate images including certain AI “digital forgeries,” and requires covered platforms to remove validly reported images within 48 hours beginning May 19, 2026, with FTC enforcement.[16,17]
- EO 14365Issued Dec 11, 2025, directs federal agencies regarding state AI laws the administration describes as burdensome. An executive order does not by itself repeal state statutes; the order text preserves space for state child-safety and state-government procurement rules.[18]
- OMB M-25-21 / M-25-22Apr 3, 2025 memoranda set federal-agency governance and acquisition expectations for AI, including inventories and contract practices aimed at reducing lock-in. They bind federal agencies; some localities reference them as models.[19,20]
European Union AI Act timeline
